Global Terms & Conditions
These Terms & Conditions ("Terms") form a legal agreement between you and SkiScout.ai ("SkiScout", "we", "us", or "our") governing your use of SkiScout Tracker, our websites, and related services (collectively, the "Services").
1. Acceptance of These Terms
By downloading, installing, accessing, creating an account for, purchasing, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services. If mandatory local consumer law gives you rights that cannot legally be waived, these Terms do not limit those rights.
2. Eligibility
The standard SkiScout service is intended for users aged 18 and older. By creating an account, you represent that you are at least 18 and legally capable of entering into these Terms. If we later offer a separate minor/family experience, additional terms and parental/guardian controls may apply.
3. What SkiScout Does
SkiScout is a recreational sports-tracking and social application. Depending on your device, permissions, location, and subscription, features may include recording precise GPS routes, calculating speed, distance, elevation/vertical change, run counts and duration, displaying maps, saving activity history, adding friends, sharing live location with selected users, comparing activity statistics, and publishing selected sessions to leaderboards or other social areas.
Features may change, be added, removed, suspended, or differ by location, platform, device, subscription, connectivity, or legal requirements.
4. Critical Safety Notice — Read Carefully
Skiing, snowboarding, mountain biking, and other outdoor sports involve inherent risks, including severe injury, permanent disability, property damage, exposure, getting lost, avalanche or terrain hazards, collision, and death.
SkiScout is a recreational tracking tool. It is not an emergency service, rescue beacon, avalanche device, medical device, navigation guarantee, safety-monitoring service, or substitute for training, judgment, proper equipment, official trail/resort information, or emergency procedures.
GPS, map, altitude, speed, route, weather-linked, and performance information may be inaccurate, delayed, incomplete, unavailable, or affected by terrain, trees, buildings, tunnels, weather, battery, network coverage, satellite availability, device sensors, software errors, or third-party data.
Do not rely on SkiScout for safety-critical decisions, determining whether a route is open or safe, locating another person in an emergency, avalanche assessment, medical decisions, or contacting rescuers. In an emergency, contact the applicable emergency service or resort/mountain patrol directly.
5. Your Responsibility While Participating in Sports
You are responsible for your own decisions, conduct, fitness, equipment, route selection, speed, surroundings, compliance with resort/trail rules, and compliance with law. Never interact with the App in a way that distracts you while moving or creates a hazard for you or others. Do not trespass, enter closed terrain, or take additional risk merely to improve statistics, rankings, badges, or leaderboard position.
6. Location Is Required to Use SkiScout
SkiScout is built around precise location tracking. In order to use the App and receive its core functionality, you must allow SkiScout.ai to process your precise location. The App uses location to record your route, calculate speed, distance, elevation and other performance information, display your position on maps, and provide related tracking features.
If you do not want SkiScout.ai to process your precise location for these purposes, do not use the App. Refusing, disabling, or revoking location permission will prevent the App from providing its core tracking functionality.
SkiScout.ai does not sell your precise location information and does not use it for third-party advertising or unrelated commercial profiling. Location is used only to provide, operate, secure, maintain, and improve the Services and to provide sharing features that you intentionally activate.
Live sharing with friends or other users is a separate social feature and should only be enabled when you intentionally want authorized recipients to see your location.
You must not use the Services to track, locate, monitor, stalk, harass, or surveil another person without their knowledge and lawful authorization. You must not attempt to bypass another user's privacy controls.
7. Accounts and Account Security
You are responsible for providing accurate account information, maintaining the confidentiality of your credentials, protecting access to your device, and promptly notifying us of suspected unauthorized access. You may not impersonate another person or create an account using information you are not entitled to use.
You are responsible for activity conducted through your account unless applicable law provides otherwise.
8. Friends, Public Sharing, and Leaderboards
Friends and social features can reveal personal information. If you enable live location sharing, selected users may be able to see your current or recent location. If you publish a session, your display name, route or route portions, activity time, statistics, and ranking may become visible to others.
Before publishing, consider whether the route could reveal your home, workplace, hotel, school, routine, or another sensitive location. You are responsible for content and information you choose to make public, subject to rights you cannot waive by law.
9. User Content
"User Content" means information or material you submit, upload, publish, or choose to share through the Services, including profile information, session titles, public activity data, and other user-submitted material.
You retain ownership of your User Content. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, adapt for technical formatting, transmit, display, and distribute User Content only as reasonably necessary to operate, secure, improve, and provide the Services and the sharing settings you select. This license ends when the relevant User Content is deleted from active systems, except for lawful retention, backups, security evidence, or content that another user has independently retained or lawfully reshared.
10. Acceptable Use
You agree not to:
- stalk, harass, threaten, intimidate, dox, or unlawfully track another person;
- share another person's precise location without authorization;
- scrape, harvest, aggregate, sell, broker, or create databases of users, routes, or location information without our written permission;
- manipulate GPS data, activity statistics, rankings, or leaderboards;
- use bots, automation, reverse engineering, or unauthorized APIs to access the Services except where law expressly permits;
- probe, attack, overload, disrupt, or circumvent security, rate limits, authentication, or access controls;
- upload malware, illegal content, infringing content, or information you do not have the right to use;
- use the Services for law-enforcement, employment, insurance, credit, housing, or other high-impact surveillance or decision-making without our written authorization and a valid legal basis;
- use the Services in violation of sanctions, export-control law, privacy law, or other applicable law.
11. Intellectual Property
The Services, including software, design, branding, logos, text, graphics, databases, and non-user content, are owned by or licensed to us and are protected by intellectual-property laws. Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to use the App for its intended consumer purpose.
No rights are granted except those expressly stated. "SkiScout" and related branding may not be used without permission.
12. Feedback
If you voluntarily provide ideas, suggestions, or feedback about the Services, you grant us permission to use that feedback without restriction or compensation, provided we do not publicly identify you as the source without permission.
13. Third-Party Services and Maps
The Services may use or link to third-party infrastructure and content, including Google Firebase, Apple services, OpenStreetMap-based map data, OpenFreeMap, OpenSnowMap, Waymarked Trails, app stores, and other providers. Third-party services may be governed by separate terms and privacy policies.
We do not guarantee the accuracy, completeness, availability, legal status, trail status, terrain condition, opening times, boundary data, rescue information, or safety of third-party maps or content.
14. Subscriptions, Purchases, Trials, and Billing
If SkiScout offers paid features, pricing, billing period, trial terms, and included features will be disclosed before purchase. Purchases made through Apple's App Store are processed by Apple and are also subject to Apple's applicable media services and subscription terms.
Unless the purchase screen states otherwise, subscriptions may automatically renew until cancelled. You can manage or cancel an Apple subscription through your Apple account settings. Deleting the App or deleting your SkiScout account does not necessarily cancel an app-store subscription. Refund rights are governed by the applicable store rules and mandatory consumer law.
15. Privacy
Our Privacy Policy explains how we process personal information. By using a feature that shares information with other users or the public, you direct us to make the selected information available according to the settings you choose.
16. Account Deletion
If account creation is available, the App will provide a method to initiate account deletion. Account deletion is intended to delete or de-identify account data we are not legally required to retain. Some records may be retained temporarily in backups, for fraud/security investigations, transaction records, dispute resolution, legal compliance, or enforcement of these Terms.
Deleting your account may permanently remove saved sessions, friend connections, leaderboard entries, and other account-linked information. You are responsible for exporting anything you want to keep before deletion where export functionality is available.
17. Suspension and Termination
You may stop using the Services at any time. We may suspend, restrict, or terminate access when reasonably necessary to protect users, investigate suspected misuse, comply with law, address security threats, prevent fraud, enforce these Terms, or discontinue the Services. Where required by law, we will provide notice or an opportunity to appeal.
Provisions that by their nature should survive termination—such as intellectual-property provisions, disclaimers, liability limitations, dispute provisions, and accrued obligations—will survive.
18. Changes to the Services
We may modify or discontinue features, subject to applicable consumer law. We do not guarantee that any feature, map layer, integration, metric, social function, or subscription benefit will remain available indefinitely.
19. Disclaimers
To the maximum extent permitted by law, the Services are provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and uninterrupted or error-free operation to the extent those warranties may lawfully be disclaimed.
We do not warrant that GPS routes, live locations, maps, performance statistics, rankings, or other data are accurate, real-time, complete, or suitable for safety, medical, professional, competitive, or scientific use.
20. Limitation of Liability
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including rights and remedies that applicable consumer-protection law makes mandatory.
To the maximum extent permitted by law, neither SkiScout nor its affiliates, officers, employees, contractors, or licensors will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of profits, loss of data, loss of goodwill, business interruption, or similar losses arising from or relating to the Services.
To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Services will not exceed the greater of (a) the amount you paid us for the Services during the 12 months preceding the event giving rise to the claim, or (b) USD 100 (or the equivalent in local currency). This cap does not apply where a liability cap is prohibited by law.
The limitations in this section are intended to allocate risk between the parties and apply only to the extent enforceable in the relevant jurisdiction.
21. Assumption of Inherent Sports Risk
To the extent permitted by applicable law, you acknowledge that outdoor and mountain sports involve risks independent of the App and that you voluntarily assume the ordinary inherent risks of the activity you choose to undertake. This clause does not waive liability that cannot legally be waived and does not excuse us from duties that mandatory law imposes on us.
22. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless SkiScout and its affiliates from third-party claims, losses, and reasonable costs arising from your unlawful use of the Services, violation of another person's rights, unauthorized tracking or publication of another person's location, or material breach of these Terms. This obligation does not apply to the extent a claim results from our own unlawful conduct or where consumer law prohibits such an obligation.
23. Export Controls and Sanctions
You may not use, export, or re-export the Services in violation of applicable export-control or sanctions laws. You represent that your use will comply with laws applicable to you.
24. Governing Law and Courts
These Terms are subject to the governing law and jurisdiction provisions that apply to SkiScout.ai's legal entity and to any mandatory consumer-protection rules that apply where you live. Nothing in these Terms removes any rights you have under mandatory local consumer law, including any right to bring a claim in a court that applicable law makes available to you.
25. Changes to These Terms
We may update these Terms to reflect legal, security, product, or business changes. We will update the "Last updated" date and provide additional notice when required. If a material change legally requires affirmative acceptance, we will request it. Continued use after an effective update constitutes acceptance only to the extent permitted by applicable law.
26. General Terms
If any provision is held unenforceable, it will be limited or severed to the minimum extent necessary and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets, subject to applicable law. You may not assign your account or rights under these Terms without our written consent.
These Terms, together with the Privacy Policy and any purchase-specific terms presented to you, constitute the agreement governing the Services, except for additional terms that law requires or that we expressly agree to in writing.
